Who can use CubbyJar

These terms are an agreement between you and IAS Digital Group LLC, 2285 S Hiawassee Rd, Suite 205, Office 16, Orlando, FL 32835, United States ("CubbyJar", "we", "us"). They cover the CubbyJar website, the web app and the CubbyJar apps for phones (together, "the service"). By creating a household, accepting an invitation or signing in, you accept these terms, the Privacy policy and the Children's privacy notice.

You must be at least 18 years old and able to enter a binding contract to create a household or join one as a grown-up. The service is built for families in the United States and priced in US dollars. If you use it from elsewhere, you may do so only where that is lawful, and you accept that we designed it with US law in mind.

A child never contracts with us. Kid accounts are created by a grown-up in the household, who is responsible for them and accepts these terms on the child's behalf. A grown-up who invites another grown-up into the household confirms that person is an adult they trust with the household's records; every grown-up in a household has the same access.

Keep your password, and each kid's family code, username and PIN, within your household. You are responsible for what happens under your sign-in. If you think someone outside the household has it, change it and tell us at security@cubbyjar.com.

Your household and its data

Everything you enter into CubbyJar (accounts, transactions, budgets, jars, chores, goals, receipts and the names of the people in your household) belongs to your household. We do not sell it, share it for advertising or use it to build profiles. The Privacy policy says what we collect, why, and who processes it for us.

You give us the permission we need to store, process, back up and display your data so the service works, and to send the emails the service needs: address verification, invitations, a locked-PIN notice, password resets and your download link. That permission ends when your data is deleted.

All grown-ups in a household see the same household data and can change it. We cannot referee disagreements between the grown-ups in a household: what one of them enters, the others can see and edit.

You can download your household's data as a JSON file at any time from inside the app, and you can delete a kid or the whole household. The Privacy policy describes both in detail.

What you pay

During the beta, CubbyJar is free. There is no trial period, no payment method on file and nothing to cancel.

When the beta ends, we will publish prices on the Pricing page and email the grown-ups in every household at least 30 days before anyone is asked to pay. Families who subscribe within a year of the day the beta ends keep the founding-family price shown on the Pricing page for as long as they stay subscribed.

If you choose not to subscribe when the beta ends, you keep the ability to download your data, and we tell you by email what happens to your household's access before anything changes.

Nothing in kid mode costs money, and nothing in kid mode can be bought. Prices, upgrade prompts and payment screens are never shown to a child.

Children's accounts

A grown-up creates each kid account, chooses the child's first name, birth year, username and PIN, and confirms consent at that moment. We record which grown-up consented and when. The Children's privacy notice describes what we hold about a child and your rights as a parent.

Money shown in a kid's jars is a record your household keeps, not money we hold. CubbyJar is not a bank, a payment service, a wallet or a custodian. No real money moves through CubbyJar, no card is issued, and we owe no balance to anyone. Paying a child what their jars show is between the grown-ups and the child.

Kid mode has no chat, no comments, no sharing, no other families, no advertising and nothing to buy. A child can see their own jars, chores, goals and payday, mark a chore done, move money between their own jars, set their own goals and take part in payday. Everything a child does in the app is visible to the grown-ups in the household.

You can end a child's access, delete the kid account (with 30 days to restore it) or delete the whole household at any time from inside the app.

Ending the agreement

You can leave at any time by deleting the household from inside the app. Before anything is purged, we export your household's data and email you a download link. The household is then removed from our live systems after 30 days, and from backups within a further 30 days.

We may suspend or end a household's access if the service is used to break the law, to attack the service or other people, or to break these terms in a way that is not fixed after we ask. We email the grown-ups first unless the law or the safety of the service prevents it, and the download stays available.

If we ever shut CubbyJar down, we will give at least 60 days' notice by email and keep the download working for the whole of that period; you can request a fresh export at any time during it.

The sections about your data, liability, governing law and anything that by its nature should continue survive the end of this agreement.

Liability

CubbyJar is a record-keeping tool. It shows what you and your household entered. It does not move money, does not verify your entries against any bank or card, and is wrong whenever an entry is wrong. Check your own bank, card or lender for what actually happened before relying on a CubbyJar figure.

We provide the service "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted or free of errors.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost savings or lost profits, arising from the service or these terms. Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars. During the free beta that means 100 US dollars.

Some states do not allow some of these limits. Where that applies to you, the limits apply only as far as the law permits. Nothing in these terms limits liability for fraud, for gross negligence or willful misconduct, or for anything the law says cannot be limited.

You agree to cover us for claims by other people that arise from your breaking these terms or the law while using the service.

Governing law and disputes

These terms, and any dispute about them or the service, are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by applicable United States federal law.

Before starting a claim, email hello@cubbyjar.com with a description of the problem. We will try to resolve it with you within 30 days. Any claim that is not resolved must be brought in the state or federal courts located in Orange County, Florida, and both of us agree to the personal jurisdiction of those courts. Either side may bring a qualifying claim in small-claims court instead.

If any part of these terms is found unenforceable, the rest still applies. These terms, the Privacy policy and the Children's privacy notice are the whole agreement between us about the service and replace anything said earlier.

Changes to these terms

We may update these terms when the service changes or the law requires it. For a change that affects your rights or what you pay, we email the grown-ups in every household at least 30 days before it takes effect. Smaller changes, such as wording, take effect when we publish them with a new "Last updated" date at the top of this page.

If you keep using the service after a change takes effect, you accept the change. If you do not accept it, delete the household before the change takes effect; the download stays available.
